FURTHER LEAVE TO REMAIN APPLICATIONS
Based on Family, Private Life, or Human Rights Grounds
If you’re already in the UK and want to extend your stay based on your family ties, private life, or human rights reasons, you may be eligible to apply for Further Leave to Remain (FLR) under one of two key categories:
FLR (FP) – Family and Private Life
The FLR(FP) application allows you to remain in the UK based on your:
- Relationship with a British or settled partner or child
- Long residence or private life in the UK (e.g., you’ve lived here for many years)
- Exceptional circumstances that would make leaving the UK unjustifiably harsh
You may apply if:
- You have a British or settled spouse/partner or child living in the UK
- You have lived in the UK for a significant period, especially since childhood
- You are unable to return to your home country due to personal, emotional, or social ties developed in the UK
- Removing you would breach your right to private and family life under Article 8 of the European Convention on Human Rights
Required Evidence:
- Proof of your relationship with family members in the UK
- Documentation showing continuous residence, ties to the UK, and integration
- Medical, educational, or psychological evidence if relevant
- Financial and accommodation details
FLR (HRO) – Human Rights Outside the Rules
FLR(HRO) is for individuals who do not qualify under the Immigration Rules, but whose removal from the UK would breach their human rights, particularly under Article 3 or Article 8 of the European Convention on Human Rights.
This route is often used in complex or compassionate cases, such as:
- Those with serious medical issues that cannot be treated in their home country
- Victims of domestic abuse or trafficking
- Individuals with no family or support system abroad
- Cases where removal would cause inhumane or degrading treatment
Processing Times & What to Expect
- FLR applications can take up to 6 months to process
- You may be granted 30 months leave (renewable)
- In some cases, it can lead to settlement (ILR) after 5 or 10 years
- You may be able to access work rights and healthcare, depending on your visa type
